1. Acceptance of terms
These Terms of Service ("Terms") form a binding agreement between you and Dara ("we", "us", "our"). By starting Dara — through Telegram, a web client, a mobile app, or any other channel we make available — or by paying for a subscription, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.
2. The Service
Dara is an AI-powered English language tutor (the "Service"). Today the Service is primarily delivered through a Telegram bot and Mini App; we plan to release native mobile apps and a web interface that share the same backend and account. The Service includes voice conversations with our AI tutor, structured lessons and exercises, personalized memory of your progress, and any related features we add over time.
Dara is an AI. Her responses are generated automatically. While we work hard to keep her accurate and helpful, she may occasionally produce incorrect, outdated, or surprising answers. You should not rely on Dara as a substitute for professional advice (educational, legal, medical, financial, or otherwise).
3. Eligibility
You must be at least 13 years old to use the Service. If you are between 13 and 18 (or the age of majority in your country), you must have permission from a parent or legal guardian. You must also be permitted to use the Service under the laws of your country.
4. Your account
Today you access Dara through your Telegram account (we don't operate a separate login on the Telegram channel). When we launch web and mobile apps, you will create or sign in to a Dara account directly. You are responsible for keeping your access credentials — Telegram account, email/password, or any future authentication factor — secure, and for everything that happens under your account.
5. Subscription, billing, and trial
5.1 Free trial
New users receive 60 minutes of free conversation time with Dara, with no credit card required. The trial begins when you open Dara for the first time and ends when you have consumed 60 minutes of lesson time or after 30 days, whichever comes first.
5.2 Subscription
To continue using Dara after your trial, you can subscribe to Dara Unlimited for USD 4.99 per month (or the equivalent in your local currency, displayed at checkout). The subscription grants you unlimited voice lessons during the active period.
5.3 Billing
You will be billed at the start of each monthly period. The subscription renews automatically at the same price until you cancel. Payments are processed by one of: Stripe (international card payments), YooKassa (card payments and local methods in Russia and CIS), or Telegram Payments / Telegram Stars (when paying inside Telegram). Prices may change with at least 14 days' notice before the change takes effect.
5.4 Taxes
Prices displayed include applicable VAT or sales tax where required. You are responsible for any taxes not collected at checkout.
6. Cancellation
You can cancel your subscription at any time from inside the Service — by opening the Dara chat in Telegram (or the corresponding settings screen in any future web or mobile app) and selecting Subscription → Cancel. Cancellation takes effect at the end of the current billing period — you keep access until the end of the period you have already paid for. After that, your account remains, but Dara becomes read-only until you re-subscribe.
7. Refunds
We offer a no-questions-asked refund within 7 days of your first paid subscription. After 7 days, we may issue refunds case by case if the Service was unusable for technical reasons on our side. Full details on the Refund Policy page.
8. Acceptable use
When using Dara, you agree not to:
- Use the Service for any illegal purpose, or in violation of any law in your jurisdiction
- Use the Service to generate, transmit, or store unlawful, harmful, threatening, abusive, harassing, defamatory, hateful, obscene, or sexually explicit content involving minors
- Attempt to reverse-engineer the Service, extract its underlying models, or scrape conversations at scale
- Use the Service to develop a competing product
- Resell, sublicense, or commercially redistribute access to the Service
- Attempt to gain unauthorized access to any part of the Service, our servers, or other users' accounts
- Interfere with or disrupt the Service, including by sending automated traffic, denial-of-service attacks, or abuse of API endpoints
- Use the Service to impersonate another person or misrepresent your identity
- Circumvent or attempt to circumvent any usage limits, security measures, or content filters
We may suspend or terminate your access if we reasonably believe you are violating these rules.
9. Content and license
Anything you say or write to Dara — your voice, your transcripts, the topics you discuss — remains yours. By using the Service, you grant us a worldwide, royalty-free, non-exclusive license to process that content to deliver the Service, remember your progress, and improve Dara, as described in our Privacy Policy. We do not claim ownership of your content and we do not sell it.
Dara's responses, exercise materials, lesson plans, and the personality of "Dara" itself are our intellectual property. You are free to discuss your lessons, share screenshots, and tell people about Dara, but you may not republish or commercially redistribute substantial portions of our content without our permission.
10. Our intellectual property
The Dara name, logo, design, software, course materials, exercise content, and all related intellectual property are owned by us or our licensors. These Terms do not grant you any ownership rights in the Service. All rights not expressly granted are reserved.
11. Third-party services
The Service relies on third-party providers including Telegram, Stripe, YooKassa, Google Cloud, Soniox, Cartesia, Supabase, and DigitalOcean. Your use of the Service is also subject to the applicable terms of those providers. We are not responsible for the actions or content of third parties, but we choose our providers carefully and require them to handle your data under contract.
12. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted operation. We do not warrant that:
- The Service will meet your specific learning goals
- The Service will be available without interruption or error
- Dara's responses will be accurate, complete, or appropriate in every situation
- Any defects in the Service will be corrected
Nothing in these Terms excludes or limits our liability for fraud, fraudulent misrepresentation, death or personal injury caused by our negligence, or any liability that cannot be excluded under applicable law.
13. Limitation of liability
To the maximum extent permitted by law, our total aggregate liability to you under these Terms, in any 12-month period, shall not exceed the greater of (a) the amount you paid us for the Service in that period, or (b) USD 100. We are not liable for indirect, incidental, consequential, special, or punitive damages, lost profits, lost revenue, lost data, or loss of goodwill, even if we have been advised of the possibility of such damages.
14. Indemnification
You agree to indemnify and hold harmless Dara, its founders, employees, and contractors against any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service in violation of these Terms or applicable law.
15. Termination
You can stop using the Service at any time. We can suspend or terminate your access if you violate these Terms, if we are required to do so by law, or if we discontinue the Service. We will give you at least 14 days' notice before discontinuing the Service entirely, and refund any unused portion of your subscription on a pro-rata basis.
16. Governing law and disputes
These Terms are governed by the laws of the jurisdiction in which Dara is established (the "Governing Law"). Any dispute arising out of or in connection with these Terms shall be resolved exclusively by the competent courts of that jurisdiction, except where mandatory consumer law in your country of residence gives you the right to bring proceedings in your local courts.
If you are a consumer in the EU, you may also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr.
17. Changes to these terms
We may update these Terms from time to time. When we make material changes, we will notify you through the Service (Telegram chat, email, or in-app notification depending on the channel you use) before the change takes effect. The "Last updated" date at the top of this page reflects the current version. Your continued use of the Service after the change indicates your acceptance of the new Terms. If you don't agree to a change, you may cancel your subscription and stop using the Service.
